Liberty Island: Bi-State Land Use Permitting

Liberty Island (once called Bedloe’s Island), home of the Statue of Liberty, lies within a unique regulatory locale with respect to the states of New York and New Jersey. An interstate agreement between New York and New Jersey places Bedloe's Island (the land above low level water mark) within New York while
New Jersey retains riparian rights to waters and all submerged land surrounding the island identified in a compact between the states ratified by US Congress in 1834. The National Park Service recently undertook two projects on the island including beach armoring of a barge landing area needed due to erosion caused by Superstorm Sandy and the construction of a temporary pier to facilitate new museum construction. Each state has overlapping tidal wetland regulations for bi-state jurisdiction: 1) NJDEP regulates tidal water up to mean high tide and 100 feet of upland beyond; and 2) NYSDEC regulates tidal lands down to the mean low water mark (on Liberty Island). This presentation will discuss the challenges associated with bi-state regulations and the solutions for these two projects.
Hoboken Northwest Resiliency Park Engineering

E&LP is the lead engineer for the green stormwater infrastructure design for Hoboken’s Northwest Resiliency Park, which at six acres is the largest urban installation of green infrastructure in New Jersey. Through the creative application of design and engineering, the Project Team aims to mitigate localized flooding while creating a 21st century park that is innovative both in the application of technology and public space. Our team proposed a dual strategy design for the park that evaluates how stormwater low impact design strategies can positively develop a park environment as well as how the social and built elements of the park can shape the approach taken to the management of stormwater.
Hoboken Northwest Resiliency Park Construction Management
Marty Portik, Michael Baker International, Inc.
Michael Baker is providing construction management services for the Northwest Resiliency Park. The project involves extensive soil sampling, testing and disposal on this former industrial site, coordination with local sewer authority for pump station construction, and construction of numerous park features, including play equipment, athletic facilities, an interactive fountain/ice rink, landscaping, and other features, most of which double as stormwater management devices.
